Local Medical Pot Provider Accused Of Dealing Drugs

SAN DIEGO -- Eugene Davidovich said he is caught in the legal middle.
"I'm very much concerned for my freedom and for the consequences," said Davidovich.
Diagnosed with severe anxiety and severe depression, Davidovich's doctor prescribed marijuana to help treat his symptoms.
"So I turned to medical cannabis and a doctor recommended it for me, and I found tremendous relief," said Davidovich.
There is no uniform system to obtain medical marijuana, so Davidovich belonged to what is called a Collective Cultivation Group.
"Not everybody is able to cultivate it themselves, so they're actually distributing the marijuana cultivated by others in the collective. I cultivated my own medication and I had extra," said Davidovich.
Last November, police said Davidovich sold a portion of his extra marijuana to an undercover police officer.
Davidovich said the officer showed him what he thought was a valid medical marijuana card.
Davidovich was arrested and charged with dealing marijuana.
It has been 13 years since California voters passed Proposition 215, which legalized the use of marijuana for medicinal purposes.
San Diego County sued the state, saying that federal law banning the use of marijuana trumps state law which allows the personal use of marijuana by people who are sick or dying to ease their symptoms.
Last month, the U.S. Supreme Court rejected the county's case, and the county will begin issuing medical marijuana cards.
10News contacted the district attorney's office about Davidovich's case, and District Attorney spokesman Paul Levikow said: "These are two separate issues. This case has nothing to do with medical marijuana cards. He is charged with dealing marijuana."
Davidovich said, "I certainly hope that I get a fair trial and a fair day in court."
Davidovich goes to court Monday, July 13.
